LabX System Outage Policy

The following document defines our commitment to provide the LabX community with the highest possible level of uninterrupted service during high-traffic hours. This document further outlines the remedies we will provide if any such instances of service interruption occur.

1.  LabX Performance Commitment
LabX endeavors to provide the community with uninterrupted access to the LabX servers Monday through Friday during the hours of 9 a.m. to 9 p.m. Eastern (New York) Time. These times are "peak" times for LabX and considered critical due to the time-sensitive nature of the auctions scheduled to close during these hours. There are circumstances beyond our control which may cause our services to become unavailable during these critical times.


2.  Definition of System Outage
LabX defines a system outage as any interruption to the LabX system caused by a software or hardware problem with the LabX servers, or a power supply or internet connectivity interruption at the facility in which the LabX servers are located during "peak" times as defined in Section 1 (LabX Performance Commitment). This policy does not apply to any interruption of service which occurs outside of our facility or which occurs at our facility during non-peak hours.


3.  Routine Upgrades and Maintenance
In order to provide the LabX community with access to the newest technologies and to keep the LabX servers in peak condition, it is necessary to perform upgrades on our system. All planned upgrades to the LabX system which require us to take our servers offline will be performed during non-peak hours. It may be necessary, from time to time, to perform unplanned system maintenance. If an event occurs where such maintenance becomes necessary, LabX will make every attempt to minimize the impact that any such service involves. Without limiting other remedies, we will apply Section 4 (LabX Remedy) to any auctions which are affected by any unplanned system maintenance.


4.  LabX Remedy
For all system outages which occur Monday through Friday during the hours of 10 a.m. to 9 p.m. Eastern (New York) time, LabX will extend all auctions affected by the outage by 1 (one) business day. LabX will notify the seller(s) of all affected auctions that such auction has been extended. LabX will also notify the current bidders on all affected auctions that such auction has been extended.
